These Terms of Service ("Terms") govern your access to and use of the AIMES platform ("Service"), provided by AIMESSALES AB, a company registered in Sweden ("AIMES," "we," "us," or "our").
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you are entering into these Terms on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" refers to both you individually and the organization.
If you do not agree to these Terms, you may not access or use the Service.
AIMES is a business-to-business (B2B) software-as-a-service platform that helps sales teams generate AI-powered analyses and messaging recommendations for their sales prospects. The Service uses artificial intelligence to analyze prospect information and generate tailored outreach suggestions.
The Service is intended for use by businesses and their authorized employees. It is not intended for personal or consumer use.
To use the Service, you must create an organization account. The person who creates the organization account becomes the organization "Owner" and accepts these Terms on behalf of the organization and all users invited to that organization.

The Service is provided on a subscription basis, priced per seat (user). Payment is processed through Stripe, Inc. By subscribing, you agree to Stripe's terms of service for payment processing.
Usage Allowances: Each subscription seat includes monthly usage allowances (currently 25 deep prospect analyses and 2,500 AI credits per seat). Allowances reset at the start of each billing cycle; unused allowances do not roll over. Current allowances are shown on our pricing page and in the Service.
One-Time Packs: We may offer one-time top-up purchases (such as the Analysis Pack) that add usage allowances. Pack balances do not expire while your account remains in good standing. Pack purchases are non-refundable.
Free Trial: New organizations may be offered a free trial (currently 14 days). Trials include limited usage allowances and seat limits, which may differ from paid subscription allowances and are shown at signup. A paid subscription is required to continue using the Service after the trial ends.
No Refunds: All fees are non-refundable. Once payment is made, you are not entitled to a refund, except where required by applicable law or as explicitly stated in these Terms.
Subscription fees are billed in advance on a monthly basis, or at another billing interval where we offer one and you select it. You authorize us to charge your payment method for all applicable fees.
We reserve the right to modify our pricing with at least 30 days' notice before the start of your next billing cycle.
Termination by You: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.
Termination or Suspension by Us: We may suspend or terminate your access to the Service immediately, without prior notice, if we reasonably believe you have:
In case of termination for cause, you are not entitled to any refund. We may, at our sole discretion, provide a pro-rated refund if we terminate your account without cause.
Upon termination, you may export your data through the Service's export functionality before your access ends.
Our Property: The Service, including its design, features, and underlying technology, is owned by AIMESSALES AB and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand features.
Your Data: You retain all rights to the data you input into the Service. You grant us a limited license to use your data solely to provide and improve the Service.
AI-Generated Outputs: You may use the AI-generated analyses, recommendations, and message drafts produced by the Service for your business purposes, including in your communications with prospects and customers.
We treat your data as confidential and process it in accordance with our Privacy Policy.
Data Controller Responsibility: For all Customer Data—including prospect information, interaction data, and AI-generated analyses relating thereto—you are the data controller under applicable data protection laws (including GDPR). AIMES acts solely as a data processor, processing Customer Data only to provide the Service.
As the data controller, you are solely responsible for:
You represent and warrant that you have the legal right to input all data into the Service and that your use of the Service complies with applicable data protection laws. You shall not input personal data into the Service unless you have a valid lawful basis to do so.
The Service uses artificial intelligence to generate sales analyses and recommendations. AI-generated content is provided for informational purposes only and should not be relied upon as the sole basis for business decisions.
You are responsible for reviewing and verifying all AI-generated content before use. AIMES makes no warranties regarding the accuracy, completeness, or suitability of AI-generated content for your specific purposes.
The AI may produce outputs that are incorrect, incomplete, or inappropriate. You should exercise your own professional judgment when using these outputs.
You are solely responsible for the accuracy, quality, and legality of the data you input into the Service. AIMES is not responsible for the quality of outputs derived from inaccurate, incomplete, or unlawful input data.
The principle of "garbage in, garbage out" applies: the quality of AI-generated analyses depends directly on the quality of the information you provide.

Your use of these third-party services is subject to their respective terms of service. AIMES is not responsible for the availability, accuracy, or conduct of any third-party service.
Disclaimer of Warranties: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIMESSALES AB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES.
Liability Cap: OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE FEES YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless AIMESSALES AB and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
We may modify, suspend, or discontinue any part of the Service at any time. For material changes that negatively affect your use of core features, we will provide at least 30 days' notice where practicable.
We are not liable for any modification, suspension, or discontinuation of the Service.
AIMES shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemic, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
You represent that you are not located in, or a resident of, any country subject to comprehensive sanctions by the European Union, United States, or United Nations (including but not limited to Russia, North Korea, Iran, Syria, and Cuba).
You agree not to use the Service for any purpose prohibited by applicable export laws or sanctions.
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service at least 30 days before the changes take effect.
Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you may export your data and terminate your account before the effective date.
Governing Law: These Terms are governed by the laws of Sweden, without regard to conflict of law principles.
Dispute Resolution: Any disputes arising from these Terms shall be resolved by the courts of Sweden.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and AIMES regarding the Service.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
